General Terms

WEB WIDE VIDEO TERMS AND CONDITIONS

Web Wide Video, LLC will be abbreviated WWV from this point forward.

The Customer shall grant WWV a non-exclusive perpetual royalty-free license to display, duplicate, and exhibit their original copyrighted works as necessary to fulfill the requirements of their original order.

The Customer explicitly does NOT grant WWV ownership of their video.

The Customer also grants WWV a non-exlucsive perpetual royalty-free license to display, duplicate, and exhibit short segments of their original material for WWV promotional or marketing purposes. These short segments shall not be of length greater than two minutes.

This agreement shall be goverened by the laws of the United States, of the state of Illinois, and of the County of Cook. If any part of this agreement shall be deemed illegal or unenforceable, it shall not nullify any other section of these terms and conditions.

The Customer agrees that any and all legal action resulting from a dispute shall be settled via binding arbitration, with the arbitrator located in Cook County, Illinois.

ACCEPTABLE CONTENT

Content depicting illegal acts will not be accepted under any circumstances.

For DVD duplication, most content is acceptable, with the exception of hate content and/or extreme violence. (i.e. no films of people dying, getting maimed, robbing a liquor store, etc.) However , WWV reserves the right to deny services on other herin unspecified grounds as determined by WWV.

For WWW hosting, there are more content restrictions due to our hosting partners. One way to "get around" these restrictions is to purchase WWV's censoring service, which will censor offensive content to the degree that it is acceptable to WWV's hosting partners. The types of content that WWV's hosting partners do not allow include (but are not limited to):

* illegal content
* invasions of personal privacy
* pornography or obscenity
* hate or incitement of violence
* graphic violence or other acts resulting in serious injury or death
* violations of copyright

COPYRIGHT

The Customer affirms by submitting their video that the Customer has secured all the necessary copy rights (including but not limited to right of duplication, right of distribution, right of public display) for any work submitted to WWV. Customer agrees to take any and all liability for such duplication, distribution and display of customer's works from WWV, including any and all financial settlements or legal fees that should arise if Customer has failed to secure any necessary rights to any portion of their work.

Customer must have copy rights for both the audio and video portion of their material.

Any notifications of breach of Copyright should be handled through the "contact us" portion of the WebWideVideo.com website.

SALES TAX

All items shipped from WWV and going to an address within the state of Illinois are subject to the local (Cook County) sales tax rate unless a valid Illinois resale certificate is sent prior to an order being placed. Any sales tax charged will not be refunded unless a certificate is in possession prior to or at the time an order is placed.

IN NO EVENT SHALL WEB WIDE VIDEO, LLC BE LIABLE FOR SPECIAL, INDIRECT, EXEMPLARY, OR CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO, LOSS OF USE, DATA, OR PROFITS, WITHOUT REGARD TO THE FORM OF ANY ACTION, INCLUDING BUT NOT LIMITED TO CONTRACT, NEGLIGENCE, OR OTHER TORTUOUS ACTIONS, ALL ARISING OUT OF OR IN CONNECTION WITH THE USE, COPYING, OR DISPLAY OF THE CONTENTS OF WWV'S WEB SITE.

In an effort to provide its customers with the most current information, WWV will from time to time make changes in the contents and in the products or services described on the WWV web site. Price, policies, availability, packaging designs, and information is subject to change without notice.

INDEMNIFICATION

CUSTOMER AGREES TO FULLY INDEMNIFY WWV FOR ALL EXPENSES WWV EXPENDS IN DEFENDING ANY ACTION ARISING FROM THE SERVICES PROVIDED BY WWV.

WEB WIDE VIDEO, LLC IS PROVIDING THIS SITE AND ITS CONTENTS ON AN "AS IS" BASIS AND MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OR CONDITIONS OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ALTHOUGH WEB WIDE VIDEO, LLC BELIEVES THE CONTENT TO BE ACCURATE, COMPLETE, AND CURRENT, WEB WIDE VIDEO, LLC DOES NOT REPRESENT OR WARRANT THAT THE INFORMATION ACCESSIBLE ON THIS SITE IS ACCURATE, COMPLETE, OR CURRENT.

DISCLAIMER OF SHIPPING COMPANY ERRORS

WEB WIDE VIDEO, LLC. WILL INSURE ALL SHIPMENTS MADE FROM WEB WIDE VIDEO FOR THE ORDER VALUE PLUS ONE HUNDRED DOLLARS US FOR THE CUSTOMER'S ORIGINAL CONTENT. IF A SHIPPING COMPANY SHOULD LOSE OR DESTROY CUSTOMER'S SHIPMENT AFTER PROCESSING BY WEB WIDE VIDEO, THIS INSURANCE SETTLEMENT SHALL BE THE SOLE REMEDY FOR THE CONSUMER.

WEB WIDE VIDEO, LLC. NEITHER ASSUMES NOR ACCEPTS LIABILITY FOR SHIPPER ERRORS UNTIL SHIPMENT HAS BEEN RECEIVED BY WEB WIDE VIDEO, LLC. CUSTOMERS ARE ADVISED TO INSURE THEIR SHIPMENTS TO WEB WIDE VIDEO AGAINST LOSS OR DAMAGE.

Captioning Service Additional Terms

WEB WIDE VIDEO TERMS AND CONDITIONS FOR CAPTIONING SERVICE

Customer affirms that captioning is a service provided by humans on sometimes less than ideal source material. Web Wide Video strives for accuracy, but cannot and DOES NOT GUARANTEE 100% caption accuracy. Web Wide Video will make a good faith attempt to caption faithfully the original source material, to the extent possible.

Captioning service is available only for English language speakers.

Customer affirms that non-native speakers, poor audio quality, low audio volume, and lack of articulation by the speaker may degrade caption accuracy significantly.

Customer affirms that if spoken dialog is too fast to be reliably read, that captioner may need to substitute an equivilent meaning but non-literally transcribed phrase instead.

Customer affirms that captioning may lag the speaker by a few seconds during fast passages.

Singing speakers, songs, background speakers (such as in a crowd) will not be captioned.
